By accessing or using FluencyIndex.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using this Service on behalf of a company or other legal entity (e.g., as an Enterprise or organisational client), you represent and warrant that you have the authority to bind that entity to these Terms. If you do not agree, do not use the Service.

FluencyIndex.ai provides an AI-proctored skills assessment ("The Gauntlet") that measures human-AI collaboration fluency across five proprietary dimensions: Articulation, Audit, Architecture, Adherence, and Augmentation (the "5A Protocol"). We use third-party AI models provided by Anthropic (Claude) and Google (Gemini) to facilitate these sessions. You acknowledge that AI output is non-deterministic by nature, and scores represent an assessment of a specific session, not an absolute or guaranteed measure of ability.

You agree not to: (a) use secondary AI tools, browser extensions, or automated scripts to solve the Gauntlet; (b) share, sell, or distribute your session tokens or account credentials; (c) attempt to reverse-engineer, scrape, or extract our proprietary scoring methodology. We reserve the right to invalidate any score where our Behavioral Telemetry detects patterns inconsistent with natural human interaction. The specific signals and thresholds used are part of our proprietary verification methodology and are not disclosed. Flagged sessions may be marked as "Unverified" at our sole discretion.

Pro Subscriptions: Pro access is billed monthly at the rate displayed at the time of purchase. Subscriptions auto-renew until cancelled. Cancellation: You may cancel your subscription at any time via your Account Dashboard or by contacting support@vyteon.com. Upon cancellation, you retain Pro access until the end of your current billing period. Cooling-Off Period: In accordance with the UK Digital Markets, Competition and Consumers Act (DMCCA) 2024, new subscribers have a 14-day statutory right to cancel for a full refund. However, by generating or downloading a Pro Report within the first 14 days of your subscription, you expressly request that the service begins immediately and acknowledge that your statutory right to cancel and receive a refund will be lost once the digital content has been fully performed. Renewal Notices: We will send a reminder notice in advance of each renewal, and a summary notice every 6 months, as required by UK DMCCA 2024. No Refunds After Report Generation: Once a Pro Report has been generated or downloaded, the service is considered "fully performed" and no refund will be issued. You may cancel at any time to prevent future charges.

Your Inputs: You retain ownership of the prompts and text you submit during the Gauntlet. Your Licence to Outputs: We grant you a perpetual, non-exclusive licence to use, share, and display your 5A Score, Pentagon Profile, and Badge for personal and professional purposes (e.g., on LinkedIn). Our Platform: Vyteon Ltd owns all rights, title, and interest in the 5A Protocol, the scoring methodology, the Gauntlet task designs, the Pentagon Profile visualisation, and all underlying software, algorithms, and trade secrets. These are protected by copyright, trade secret law, and (where applicable) patent rights. You may not copy, modify, decompile, reverse-engineer, or create derivative works based on any part of the Service.

The Service uses advanced AI models that are inherently non-deterministic. Scores, narrative insights, and illustrative rewrites are generated algorithmically and represent estimates of fluency based on specific session data. They are not an absolute truth, professional certification, or guarantee of competence. Vyteon Ltd makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any AI-generated output. Our proprietary scoring rubrics, weights, and verification methods are trade secrets, and users have no right to access, inspect, or challenge the underlying methodology.

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your session data is not used to train third-party AI models. Session telemetry and scoring data are stored securely in encrypted databases. Anonymised, aggregated benchmark data may be used to compute global averages and improve the Service. Decision-Support Tool: FluencyIndex.ai is a decision-support tool, not a decision-making tool. Automated 5A scores must not be used as the sole basis for employment decisions without human review. Vyteon Ltd provides objective data; the final decision must always involve a qualified human reviewer. Independent Tool: Vyteon Ltd provides a software-as-a-service (SaaS) assessment platform. We are not an employer, headhunter, or recruitment firm. Third-Party Decisions: Any use of a FluencyIndex report by a third party (including potential employers or organisations) is at that third party's sole discretion. Vyteon Ltd expressly disclaims any liability for employment outcomes, including but not limited to: failure to be hired, termination of employment, or loss of earnings. Employer Responsibility: Under the Equality Act 2010 and UK GDPR, any organisation using our tool as part of a hiring, promotion, or workforce assessment process is the "Data Controller" for that decision and is responsible for ensuring their process is fair, non-discriminatory, and compliant with Article 22 (automated decision-making) requirements.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VYTEON LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF EMPLOYMENT OPPORTUNITIES, LOSS OF PROFITS, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE OR THE ACCURACY OF ANY AI-GENERATED SCORE. Our total aggregate liability to you for any claim arising from or relating to the Service shall not exceed the total amount you have paid to Vyteon Ltd in the twelve (12) months immediately preceding the claim. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law.

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
